These Terms of Service form a binding agreement between you and Lusso Veloce (“Lusso Veloce,” “we,” “us,” or “our”), an independent luxury and exotic vehicle rental service based in Hamilton, Ontario, Canada. They govern your access to and use of our website, booking platform, and any vehicle you rent or experience you book through us. By creating an account, making a reservation, or using the Services, you agree to be bound by them.
Acceptance of these Terms
By accessing or using the Services, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. If you do not agree, you must not use the Services. If you use the Services on behalf of another person or an organization, you represent that you are authorized to bind them, and “you” includes that person or organization.
A separate written rental agreement may be provided at the time you collect a vehicle. If there is any conflict between that signed rental agreement and these Terms for a specific rental, the signed rental agreement controls for that rental.
Definitions
- “Vehicle” means any car or other vehicle offered for rent through the Services.
- “Booking” or “Reservation” means a request to rent a Vehicle or book an Experience for a defined period.
- “Experience” means a curated, fixed-length package we offer, which may be guided and is generally provided without a security deposit.
- “Rental Period” means the period from the scheduled pick-up to the scheduled return.
- “Authorized Driver” means you and any additional driver we have approved in advance and in writing.
- “Security Deposit” means the refundable pre-authorization hold described in the Security Deposit section.
Eligibility & Driver Requirements
To use the Services and rent a Vehicle, you must meet all of the following at the time of booking and on the pick-up date:
- Be at least 18 years old and able to form a legally binding contract to create an account and use the Platform;
- Be at least 23 years old on the pick-up date to reserve and drive a Vehicle. Drivers aged 23 to 24 are eligible but pay a young-driver fee (see Pricing);
- Hold a full, valid driver’s licence — a full Ontario Class G, or a foreign or out-of-province licence that is valid and recognized for driving in Canada — that is not suspended, expired, or restricted;
- Submit your licence details and a clear photo of your licence for verification, and pass our verification before your first reservation;
- Provide proof of valid personal automobile insurance meeting our Insurance requirements;
- Provide a valid payment card in your own name with sufficient available credit for the rental charges and the Security Deposit; and
- Have an acceptable driving record and not be barred by us under these Terms.
We may decline, suspend, or cancel any Booking or account at our reasonable discretion, including where we cannot verify your identity, age, licence, or insurance, or where we have a good-faith concern about safety, fraud, or misuse.
Accounts & Verification
You must create an account to book. You agree to provide accurate, current, and complete information — including your legal name, contact details, date of birth, and driver’s licence information — and to keep it up to date. You are responsible for all activity under your account and for keeping your login credentials confidential. Notify us immediately of any unauthorized use.
You authorize us to collect, verify, and use the information you submit (including your licence and date of birth) to confirm your eligibility, as described in our Privacy Policy. Providing false, misleading, or fraudulent information is a material breach of these Terms and may result in cancellation without refund and a permanent ban from the Services.
Bookings, Requests & Confirmation
Submitting a Booking creates a request, not a guaranteed reservation. A request is a soft hold: it appears on the calendar but does not block other customers until it is approved. We confirm or decline requests at our discretion. A reservation is only confirmed when we mark it confirmed and, where required, payment has been authorized or captured.
Unapproved requests automatically expire after a short window so the calendar stays accurate, and we may limit how many open requests a single account may hold at once. Vehicle availability, pricing, and Experience details are subject to change until your reservation is confirmed. We try to keep listings accurate but do not warrant that descriptions, images, specifications, or prices are error-free, and we may correct errors or cancel a Booking affected by an obvious error.
Pricing, Fees & Taxes
The price shown at checkout is calculated transparently and may include the following components:
- Daily rate — the base nightly rate for the Vehicle.
- Weekend surcharge — nights falling on Friday, Saturday, or Sunday carry a +20% premium on the base daily rate.
- Young-driver fee — $40 per day for Authorized Drivers aged 23 to 24 on the pick-up date.
- Add-ons — any optional extras you select (such as delivery, an additional driver, or chauffeur service), priced as shown.
- Service fee — a platform/booking fee of 10% of the rental subtotal.
- Taxes — Ontario HST of 13% applies to taxable charges.
- Distance — 200 km / day included. Distance beyond the included allowance is billed at $0.99 / km, charged after return.
Experiences are offered at a fixed, all-in package price for a fixed length, regardless of which eligible Vehicle you choose, and are generally provided without a Security Deposit. The price you see at checkout is the price we charge; we re-calculate every total on our servers from current rates so the preview and the charge always match.
Additional charges may apply after your rental for items described in these Terms — for example excess distance, fuel, cleaning, late return, tolls, fines, or damage. You authorize us to charge these amounts to your payment card.
Payments & Promotions
Payments are processed by our third-party payment provider, Stripe. We do not store your full card number; it is handled directly by Stripe under its own terms and security standards. By providing a payment method, you authorize us (through Stripe) to charge the rental total, the Security Deposit hold, and any additional amounts permitted under these Terms.
Promo codes and gift cards, where offered, are subject to their own conditions: they have no cash value except as applied to an eligible booking, cannot be combined except where we expressly allow it, may carry expiry dates or usage limits, and may be withdrawn or invalidated if obtained through error, fraud, or abuse. A gift card may be applied to the rental portion of a booking; the Security Deposit is always placed on a valid payment card.
Distance, Fuel & Vehicle Condition at Return
You agree to return the Vehicle on time, to the agreed location, in the same condition you received it (reasonable wear excepted), and:
- With at least the same fuel level as at pick-up, or you will be charged for refuelling plus a reasonable service fee;
- Reasonably clean, free of excessive dirt, odours, stains, or pet hair; an additional cleaning or detailing fee applies for returns requiring more than ordinary cleaning, including a fee for smoking in the Vehicle;
- Having stayed within the included distance allowance, or the excess-distance rate above will apply.
Security Deposit (Authorization Hold)
For most rentals we place a refundable pre-authorization hold on your payment card as a Security Deposit. The amount varies by Vehicle and is shown at checkout. The hold is not a charge; it temporarily reserves funds. We release the hold within approximately five (5) business days after the Vehicle is returned, subject to inspection and provided there are no amounts owing.
You authorize us to apply the Security Deposit (and, if it is insufficient, to charge your payment card) toward any amounts you owe under these Terms, including but not limited to damage, loss, theft, cleaning, fuel, excess distance, late return, towing, tolls, fines, administrative fees, and any insurance deductible or loss not covered by your insurance. Applying the Security Deposit does not limit your liability for amounts that exceed it.
Cancellations, Changes & Refunds
Our cancellation policy is built into the platform and applied automatically based on how far ahead of pick-up you cancel:
- 7 or more days before pick-up: full refund of the rental charge.
- Inside 7 days but more than 48 hours before pick-up: 50% refund of the rental charge.
- Inside 48 hours before pick-up: the rental charge is non-refundable, and cancellations can no longer be made through the platform.
Refunds are issued to your original payment method, and any Security Deposit hold is released in full. Experiences and certain promotional bookings may carry different or stricter terms, which we will disclose at checkout. We may, at our discretion, offer changes to dates or Vehicles subject to availability and any price difference. If we cancel a confirmed reservation for reasons other than your breach, we will refund amounts you paid for that reservation; this is your sole remedy for our cancellation.
Pick-up, Return & Late Return
Standard pick-up is at 9:00 AM and return by 8:30 AM, at the location we agree, unless otherwise arranged. You must present your valid licence, proof of insurance, and the payment card used to book. The Vehicle is inspected at pick-up and return; we recommend you review and confirm its condition with us.
Returning a Vehicle late, without prior agreement, may incur an additional day’s rental plus a reasonable late fee, and may affect the next customer’s reservation. A Vehicle not returned and not accounted for may be reported as stolen. You remain responsible for the Vehicle until it is returned to us and inspected.
Permitted Use & Driver Conduct
The Vehicle may be operated only by Authorized Drivers, only for lawful personal use, and only in accordance with these Terms. You agree to operate it safely, obey all traffic laws, and treat it with care.
Prohibited Uses
You must not, and must not allow anyone to, use the Vehicle:
- While under the influence of alcohol, cannabis, drugs, or any substance that impairs driving, or with a blood-alcohol concentration at or above the legal limit;
- For any race, speed contest, track or competition event, rally, performance test, or stunt — except where expressly arranged as part of a supervised Experience;
- By any driver who is not an Authorized Driver, or to teach another person to drive;
- To carry passengers or property for hire, for ride-share or delivery services, or for any other commercial purpose;
- To tow or push anything, or to carry hazardous, illegal, or improperly secured materials;
- Off paved roads, in a way that damages the Vehicle, or contrary to the manufacturer’s guidance;
- To transport more passengers or weight than the Vehicle is rated for, or to commit any crime or unlawful act;
- Outside the Province of Ontario, or outside Canada, without our prior written consent; or
- To sublet, rent, lease, sell, or pledge the Vehicle, or to remove it from Canada.
Any prohibited use is a material breach, may void insurance coverage, may immediately terminate the rental, and makes you fully responsible for all resulting loss, damage, and liability.
Insurance
You are required to maintain, and to provide proof of, valid personal automobile insurance that covers your operation of the rented Vehicle, including comprehensive and collision coverage. In Ontario this typically requires an OPCF 27 endorsement (or equivalent coverage) extending your policy to non-owned/rented vehicles. Your insurance is primary.
You are responsible for any deductible, and for any loss, damage, or liability that your insurance does not cover. You agree that we are not your insurer and do not provide insurance to you. If a claim arises, you agree to cooperate fully, to provide all information reasonably required, and to report incidents to us and to the police where applicable. Driving in breach of these Terms may void your coverage and leave you personally responsible for the full loss.
Damage, Loss, Theft & Your Responsibility
You are responsible for the Vehicle from pick-up until it is returned to us and inspected. You are liable for all loss of or damage to the Vehicle during the Rental Period — regardless of fault or cause, including collision, theft, vandalism, fire, weather, mechanical damage caused by misuse, interior damage, and damage from prohibited use — up to the full cost of repair or replacement. This may include, in addition to repair or replacement cost:
- Loss of use while the Vehicle is unavailable for rental during repair;
- Diminished value of the Vehicle following major damage;
- Towing, storage, recovery, and appraisal costs; and
- A reasonable administrative fee for processing the claim.
You authorize us to charge these amounts to your payment card and to apply the Security Deposit toward them. Your liability is not limited to the Security Deposit amount.
Tickets, Tolls, Fines & Violations
You are responsible for all tolls, parking charges, red-light and speed-camera notices, traffic and parking tickets, impound fees, and other fines, penalties, and charges arising during your Rental Period, plus a reasonable administrative fee for each that we must process or forward. You authorize us to identify you to the issuing authority as the responsible driver.
Mechanical Issues, Accidents & Roadside
If a warning light, mechanical problem, accident, theft, or breakdown occurs, stop driving as soon as it is safe, take reasonable steps to protect the Vehicle, and contact us immediately at (365)-336-6963. In an accident, also call the police where required, exchange information, do not admit fault, and document the scene. Do not arrange repairs or towing without our authorization unless necessary for safety. You must report any incident to us before the end of the Rental Period.
Experiences & Curated Packages
Experiences are fixed-length, fixed-price packages and may be guided. You select an eligible Vehicle and a start date; the package length is set by the Experience. Experiences are generally offered without a Security Deposit, but all other terms — eligibility, licence, conduct, prohibited uses, and your responsibility for damage caused by misuse — continue to apply. Specific inclusions and any additional conditions are shown on each Experience’s page.
Reviews & User Content
If you submit a review, rating, comment, or other content, you grant us a non-exclusive, royalty-free, worldwide, perpetual licence to use, display, reproduce, and adapt it in connection with the Services. You are responsible for your content and represent that it is accurate, that it is yours to share, and that it is not unlawful, defamatory, infringing, or otherwise objectionable. We may remove or decline to publish content at our discretion, and we may moderate or edit it for length or clarity.
Assumption of Risk, Release & Waiver
You understand that operating high-performance, luxury, and exotic vehicles involves inherent risks, including the risk of property damage, serious bodily injury, or death, to you and to others. To the fullest extent permitted by law, you voluntarily assume all such risks and agree that you rent and operate the Vehicle and participate in any Experience at your own risk.
To the fullest extent permitted by law, you release, waive, and discharge Lusso Veloceand its owners, operators, employees, agents, and affiliates (the “Released Parties”) from any and all claims, demands, damages, and liability for loss, injury, or death arising out of or related to your use of the Vehicle, the Services, or any Experience, except to the extent caused by the Released Parties’ gross negligence or wilful misconduct or where such a release is not permitted by law. Nothing in these Terms limits liability that cannot be limited under applicable law.
Disclaimers
The Services and Vehicles are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, conditions, and representations of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, secure, or error-free, or that any Vehicle will be available at a particular time. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.
Limitation of Liability
To the fullest extent permitted by law, the Released Parties will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, loss of use, or loss of goodwill, arising out of or related to these Terms or the Services, even if advised of the possibility. To the fullest extent permitted by law, the Released Parties’ total aggregate liability arising out of or related to a given rental or Experience will not exceed the amount you actually paid to us for that rental or Experience. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
Indemnification
You agree to indemnify, defend, and hold harmless the Released Parties from and against any claims, liabilities, damages, losses, fines, penalties, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Vehicle, the Services, or any Experience; (b) your breach of these Terms or of any law; (c) your negligence or wilful misconduct; (d) any damage, injury, or death you cause; and (e) any claim brought by a third party, passenger, or additional driver relating to your rental.
Force Majeure
We are not liable for any failure or delay in performing our obligations caused by events beyond our reasonable control, including severe weather, natural disasters, fire, accidents, mechanical failure, theft, strikes, supply or staffing shortages, outages of third-party providers, government action, or public-health measures. Where such an event affects your reservation, we will work with you in good faith to reschedule or provide a refund of amounts paid for the affected reservation.
Suspension & Termination
We may suspend or terminate your account or access to the Services, and may refuse or cancel any Booking, at any time and at our reasonable discretion — including for breach of these Terms, suspected fraud, safety concerns, or non-payment. On termination, provisions that by their nature should survive (including those on the Security Deposit, insurance, your responsibility for damage, the waiver, limitation of liability, and indemnification) will survive. You may stop using the Services and request deletion of your account as described in our Privacy Policy.
Intellectual Property
The Services, including the Lusso Veloce name, logo, design, text, graphics, and software, are owned by us or our licensors and are protected by intellectual-property laws. We grant you a limited, personal, non-transferable, revocable licence to use the Services for their intended purpose. You may not copy, modify, distribute, scrape, reverse-engineer, or create derivative works from the Services except as permitted by law or with our written consent.
Third-Party Services
The Services rely on third-party providers — including Stripe (payments), Supabase (authentication, database, and file storage), Resend (email), and Vercel (hosting). Your use of those features may also be subject to the providers’ own terms. We are not responsible for the acts, omissions, or content of third parties, and links to third-party sites are provided for convenience only.
Privacy
Our collection and use of personal information is described in our Privacy Policy, which forms part of these Terms. By using the Services you consent to that collection and use.
Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-laws rules. Subject to any non-waivable rights you have under applicable consumer-protection law, you and we agree to the exclusive jurisdiction of the courts of the Province of Ontario for any dispute arising out of or related to these Terms or the Services.
Before starting any formal proceeding, you agree to first contact us at nikolaanastasijevic0@gmail.com and attempt in good faith to resolve the dispute informally. Any claim must be brought within the time period required by applicable law.
Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above and, where the changes are material, take reasonable steps to notify you. Changes apply to Bookings made after they take effect; your continued use of the Services after an update means you accept the revised Terms.
General
These Terms, together with our Privacy Policy and any signed rental agreement, are the entire agreement between you and us regarding the Services. If any provision is found unenforceable, the rest remain in effect and the unenforceable provision will be limited or removed to the minimum extent necessary. Our failure to enforce a provision is not a waiver of it. You may not assign your rights or obligations without our consent; we may assign ours in connection with a reorganization or transfer of our business. Headings are for convenience only.
